Appellate court increases employers’ likelihood of being sued under ADA
A recent ruling in the Tenth Circuit found that an employee need not be adversely affected to be able to sue under the Americans with Disabilities Act, meaning employers should continue to engage in good faith in the ADA-interactive process.
