TREASURY DELEGATES CUSTOMS FUNCTIONS TO HOMELAND SECURITY

   The U.S. Treasury Department has delegated authority over U.S. Customs revenue functions to the Department of Homeland Security.

   The Homeland Security Act of 2002 requires that legal authority over Customs revenue functions vested in the Secretary of the Treasury “shall be retained (by the Treasury), but may be delegated to the Secretary of Homeland Security in whole or in part.”

   “I note that the use of the term ‘transferred’ with respect to certain authority … shall continue to be understood to effect only a delegation,” said John W. Snow, Treasury Secretary.
