APPEALS COURT REVERSES “HEARTLAND” VERDICT
The U.S. Court of Appeals for the Federal Circuit has supported U.S. Custom’s power of classification by reversing a decision by the U.S. Court of International Trade in a case involving sugar syrup'imported by Heartland'By-Products.
Customs appealed a ruling that Customs had wrongfully declared Heartland’s syrup under the U.S. Harmonized Tariff Schedule.
''”The Court of International Trade went too far…in'its narrow construction” of the derivation of sugar syrups, the appeals court said. “We see no reason to disturb Customs’ interpretation.”
