Appeals court upholds FMC decision
The U.S. Court of Appeals for the District of Columbia has denied a petition for review requested by New Orleans Stevedoring Co., a stevedoring company, of a decision by the Federal Maritime Commission.
The FMC had determined that a marine terminal operator had not unreasonably refused to deal or negotiate with the stevedoring company.
After being petitioned to review the case, the appeals court ruled that the commission’s decision was supported by sufficient evidence, and was consistent with previous determinations.
