FMC posts notice of discrimination complaint

   The Federal Maritime Commission said a complaint has been filed by World-Wide Express, Inc., against Stevedoring Services of America, Terminals Inc. (SSAT), Argosy Transport Inc., and Capt. S.L. Huo.

   World-Wide Express’s complaint concerned “several shipments of containers moving from Shanghai to Los Angeles,” the FMC said.

   World-Wide Express alleged “that SSAT refused to deal with it and directed it to contact Argosy and its principal, Capt. S.L. Huo. Complainant asserts that it entered into a contract with Argosy which contains rates that complainant contends were not published in a tariff,” the FMC said.

   World-Wide also contended that Argosy contracted with SSAT to provide terminal services at rates substantially less than SSAT published in its tariffs, the FMC said.

   World-Wide Express is seeking $380,000, plus interest at the rate of 2 percent per month, the FMC said.

   The proceeding has been assigned to the Office of Administrative Law Judges. The initial determination by a presiding officer will be issued by Feb. 21, 2005, and the final decision by June 21, 2005.
