Justice department files motion to dismiss harbor tax refunds
The U.S. Justice Department has filed a motion with the Court of International Trade to establish a procedure for disposing of all cases in which plaintiffs have sought the refunding of export harbor maintenance tax payments, as well as interest on such repayments.
The government requested that the trade court dismiss all outstanding cases, subject to individual plaintiffs taking action to oppose the dismissal of their cases.
The Justice Department asserted in its motion that all challenges with respect to the payment of interest have been resolved, and all available refunds have been issued.
Customs and Border Protection is in the process of denying protests filed with respect to administrative refund actions.
