U.S. Army Corps, GAO reject contract protest from DLH

   The U.S. Army Corps of Engineers and the Government Accounting Office denied a protest by DLH Construction and Trucking Co., which contested its loss of a contract to handle stone material to repair navigation structures in Illinois and Indiana.

   The successful contractor, Holly Marine Towing, will deliver and unload the stone onto a government-operated stone dock located on the Calument River in Chicago. The contract is an indefinite-delivery/indefinite quantity fixed-price contract for a base period with four one-year option periods.

   While DLH offered the lower bid package to the Corps, the contracting officer discovered that DLH’s bid was accompanied by a cover letter that it will “accept award of A, B, and C (stone grades) together.” The Corps rejected the bid because it limited its rights under the options provisions.
