UPS WINS DISMISSAL
A federal appeals court in San Francisco has upheld a lower court’s
dismissal of a claim that United Parcel Service monopolized the market for next-day
surface deliveries of small parcels.
The antitrust complaint was filed by California-based Western Parcel Express,
a regional parcel delivery competitor to UPS.
Western Parcel alleged that UPS used predatory pricing and private contracts
to freeze competitors out of the business-to-business parcel market.
The 9th U.S. Circuit Court of Appeals said that "there is simply no
evidence before us that there are unnatural market barriers precluding robust
competition."
